Waltham Forest Council hid abuse report after school legal threat

Concerns raised in 2016 about the misuse of calming rooms at Whitefield School in Waltham Forest were not addressed by the council after the Flourish Learning Trust threatened legal action. A review commissioned by Waltham Forest Council, conducted by the British Institute for Learning Disabilities (BILD), identified issues with the use of these rooms. The findings were effectively suppressed following a legal challenge from the academy.

The failure to act on the BILD report's findings meant the calming rooms remained operational for an additional six months. This period continued until an Ofsted inspection in January 2017 prompted their closure. Between 2014 and 2017, 38 pupils reportedly experienced physical and psychological abuse while confined in these rooms. Allegations of mistreatment, including children being left alone for extended periods and subjected to physical force by staff, surfaced publicly in 2021 after new school leadership discovered secret CCTV footage.

Suppression of Findings

The Local Child Safeguarding Practice Review (LCSPR), published in July, revealed that evidence of the threatened legal action emerged through Metropolitan Police investigations, including email exchanges between the school and council. BILD stated it was unaware of the legal threat. The council attributed its inaction on the BILD findings to staff turnover, stating it could not explain why the report did not trigger broader scrutiny until the Ofsted inspection.

The BILD review, which examined four special needs settings in Waltham Forest, was commissioned as part of a plan for implementing positive behaviour support, not in response to specific existing concerns. The council stated that after the report was withdrawn, it did implement BILD's recommendation to review behaviour support plans for two pupils frequently placed in calming rooms.

Missed Opportunities and Consequences

The LCSPR identified the failure to act on the BILD concerns as one of several missed opportunities for agencies to build a comprehensive understanding of the calming room misuse. The review concluded that information held across different organisations, including the local authority, was not sufficiently connected to identify a cumulative risk pattern. It suggested that greater professional curiosity and challenge should have been applied.

Following the January 2017 Ofsted inspection, Waltham Forest Council conducted its own review, but this focused primarily on governance and school improvement rather than potential harm to children. Daisy Richards, Waltham Forest's cabinet member for children and young people, described the events as "deeply upsetting and distressing" and pledged to examine partnership working arrangements, implement clearer escalation thresholds, and strengthen information sharing between partners. All schools in the borough will be asked to review safeguarding training.

Ricardo Gloria, whose son David experienced abuse in the calming rooms, expressed feeling let down by multiple parties, citing delays and a lack of accountability from the school and local authority. Nine other families are involved in civil legal action against Flourish Learning Trust and the council, alleging breaches of duty of care, false imprisonment, and human rights violations related to the use of restrictive practices at Whitefield School between 2014 and 2017.

Alison Millar, a partner at Leigh Day representing the families, stated that the children and families have endured the consequences of a regime of isolation at Whitefield School that should never have been permitted. She highlighted the profound harm caused and its ongoing impact on families.
